Nando Dwi Kurniawan, Agung Abdul Rahman Wiyono, Azis Setyagama. A legal review of criminal liability in medical malpractice cases in Indonesia

The criminal liability of medical personnel in cases of malpractice is a crucial issue in health law, demanding legal certainty alongside the protection of patient rights and the preservation of professional standards. This paper aims to analyse the concept of criminal liability for medical personnel whose actions performed outside professional standards result in harm to patients. The study focuses on instances of medical malpractice that give rise to criminal legal consequences. The research method used is a normative juridical method with a statutory and conceptual approach. The findings indicate that medical personnel may be held criminally liable if an element of fault whether negligence or intentional misconduct is proven to have caused patient harm or death. This element of fault must be rigorously established by considering professional standards, the causal link between the medical action and the resulting outcome, and expert medical testimony. However, not all medical errors constitute criminal offenses; the application of criminal law to medical personnel must be selective and proportionate to maintain a balance between protecting patients and safeguarding responsible medical practice.

Techa Djoumessi Franck Jiresert. From digital sovereignty to post-human statecraft: BRICS technological cooperation and the metamorphosis of interstate relations in the age of transhumanization

This article examines how technological cooperation among the BRICS states is reshaping the foundations of interstate relations at a moment when artificial intelligence, biotechnology and human enhancement research are converging into what the author terms the transhumanization of statecraft. Moving beyond accounts that treat digital sovereignty and human enhancement as separate policy domains, the study proposes a unified analytical lens built around the concept of informational hedging, understood as the simultaneous pursuit of technological autonomy and selective interdependence by states seeking to manage dependence on external powers. Drawing on the 2024 Kazan Declaration, the BRICS Artificial Intelligence Cooperation Framework and recent scholarship on digital sovereignty in Africa, the paper traces how BRICS institutions have translated declaratory commitments into instruments such as the BRICS Institute of Future Networks, the BRICS Rapid Information Security Channel and the BRICS Artificial Intelligence Research and Innovation Centre. The analysis further considers how the convergence of artificial intelligence with biotechnology and human enhancement research introduces a post-human dimension into the balance of power, one in which the object of competition is no longer only territory, capital or information but the biological and cognitive capacities of populations. The article concludes that BRICS technological cooperation should be read not as a coherent bloc strategy but as a loosely coupled architecture of hedging practices through which member and partner states, including African states, attempt to convert technological dependency into a bargaining asset within a metamorphosing, multipolar international order.

Agung Abdul Rahman Wiyono, Nando Dwi Kurniawan, Azis Setyagama. A legal review of civil liability in medical malpractice cases in Indonesia

Medical malpractice is a complex legal issue involving aspects of criminal law, civil law and medical ethics. Medical malpractice cases often result in both physical and psychological harm to patients, thus demanding legal accountability from medical personnel. This study aims to analyse the forms of civil liability in medical malpractice cases and the obstacles to law enforcement. The research method used is a normative juridical method with a statutory and conceptual approach. The results show that civil liability focuses more on the existence of unlawful acts or breaches of contract that cause harm to patients. Law enforcement in medical malpractice cases still faces obstacles in obtaining evidence and differing views between the legal and medical professions.

Techa Djoumessi Franck Jiresert. The main obstacles and prospects for optimizing cooperation between the BRICS countries in the field of information technology

This article examines the obstacles to and the prospects for deeper cooperation among the BRICS countries in the field of information technology. It argues that digital sovereignty is at once the main motive for such cooperation and its principal constraint. The study reviews the institutional architecture that BRICS has built since 2017, including the Partnership on the New Industrial Revolution, the Digital BRICS Task Force and the remote sensing satellite constellation, and then identifies five obstacles: structural heterogeneity, divergent data-governance regimes, technological dependence on Western suppliers, the rivalry between China and India, and weak institutionalization. It then assesses the most promising tracks for optimization, among them cross-border payment infrastructure, a shared data-governance framework, digital public infrastructure, sovereign artificial intelligence and space-based data. The article concludes that the prospects are real but uneven, and that progress depends less on technical capacity than on a governance design that preserves national control while allowing systems to interoperate.

Wahibatul Maghfuroh, Herdy Pratama Susantyo, Azis Setyagama. Harmonization of Islamic inheritance law and the civil code in Indonesia from the perspective of the principles of justice and legal certainty

This study aims to formulate a model for harmonizing Islamic inheritance law and the Indonesian Civil Code based on the principles of justice and legal certainty. Indonesia has a pluralistic legal system that encompasses Islamic law, customary law and Western civil law, thus giving rise to dualism of norms, conflicts of inheritance rights and the practice of choosing judicial authority subdivisions. Islamic inheritance law emphasizes substantive justice through the faraidh system, while the Civil Code emphasizes individual freedom through testamentary freedom, so that these differences in principle create tensions between distributive justice and formal justice, as well as between legal certainty and legal flexibility. The study uses normative methods with legislative, conceptual and comparative approaches, as well as qualitative analysis of primary, secondary, and tertiary legal materials. The results of the study indicate the need for harmonization of inheritance law through three levels: normative integration of the principles of substantive justice and legal certainty, preparation of systematic national regulations and implementation of empowering judges in the application of progressive law. The paper offers a conceptual contribution in the form of an adaptive and applicable model of harmonization of inheritance law, as well as practical recommendations for regulatory.

Harmoko, Azis Setyagama. Out-of-court land dispute resolution forum by the National Land Agency in Indonesia

This study aims to determine how the process of resolving land disputes outside the court by the National Land Agency. The method used in this study is a normative juridical approach. The paper discusses the process of resolving disputes outside the court through mediation carried out by the National Land Agency as a mediator. It begins with an agreement between both parties to resolve the land dispute through mediation. Then both parties submit this agreement to the National Land Agency Office. The next stage is the implementation of mediation, starting from discussion to providing final decision. After successful mediation and reaching an agreement, a peace deed is made to be registered with the District Court. Fundamentally, a mediator acts as an intermediary who helps the parties to resolve the dispute they face. A mediator will also help the parties to provide an understanding of the existing problem to be fixed together. In addition, to reach an agreement, a mediator must also help the parties to formulate various dispute resolution options. Of course, these options must be acceptable and satisfactory to both disputing parties. At least the main role that a mediator must play is to bring together differing interests, in order to reach a meeting point that can be used as a benchmark for solving the problem.

Wahibatul Maghfuroh, Herdy Pratama Susantyo, Azis Setyagama. Legal implications of unregistered marriages in Indonesia on the status of children according to Islamic and positive law

The problem of unregistered marriages in Indonesia remains a complex issue that raises legal matters, particularly regarding the status of children. In Islamic law, unregistered marriages that fulfil the pillars and requirements of sharia, such as the presence of a guardian, witnesses and the consent are still considered valid, so that children born from them have a clear lineage to their father and obtain basic rights, including inheritance. However, in Indonesia a marriage is considered valid only if it is registered in accordance with Article 2 paragraph (2) of Law Number 1 of 1974 in conjunction with Law Number 16 of 2019. As a result, children from unregistered marriages are often only recognized as having a civil relationship with their mother, unless there is recognition or a court ruling, as affirmed in Constitutional Court Decision Number 46/PUU-VIII/2010. The paper uses a juridical-normative approach with a framework of lineage theory in Islamic law, legality theory in positive law, child protection theory, and progressive legal theory. Data were obtained through a review of literature, legislation, and court decisions. The research findings indicate a dual status for children born into unregistered marriages: legitimate according to religion, but not fully protected by state law. This discrepancy has implications for lineage rights, inheritance, population administration and child protection. The paper concludes that legal harmonization is essential. The state needs to strengthen the marriage confirmation mechanism, and establish marriage registration as an administrative tool to ensure legal child protection.
